TERMS AND CONDITIONS

Article 1 – Definitions
In these terms and conditions, the following definitions apply:

  • Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person not acting in the course of a profession or business who enters into a distance agreement with the entrepreneur.

  • Day: Calendar day.

  • Duration Transaction: A distance agreement concerning a series of products and/or services, the delivery or performance of which is spread over time.

  • Durable Medium: Any means enabling the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unaltered reproduction.

  • Right of Withdrawal: The consumer’s right to cancel a distance agreement within the cooling-off period.

  • Entrepreneur: A natural or legal person offering products and/or services to consumers at a distance.

  • Distance Agreement: An agreement concluded within the framework of a system organized by the entrepreneur for distance sales of products and/or services, using exclusively one or more means of remote communication up to and including the conclusion of the agreement.

  • Means of Remote Communication: A tool used to conclude an agreement without the consumer and entrepreneur being physically present in the same location.

  • General Terms and Conditions: The present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These terms and conditions apply to all offers, distance agreements, and orders between the entrepreneur and the consumer.

  2. The text of these terms and conditions will be made available to the consumer before the conclusion of the distance agreement. If this is not reasonably possible, the entrepreneur will indicate where the terms can be accessed and will send them free of charge upon request.

  3. For electronically concluded agreements, the terms may be provided electronically in a storable format. If not feasible, the entrepreneur will indicate how to access them electronically.

  4. In case of conflicting terms, the consumer may invoke the most favorable provision.

  5. Invalid provisions do not affect the validity of the remaining terms. Unregulated situations will be interpreted in the "spirit" of these terms.

Article 4 – The Offer

  1. Offers with limited validity or conditions will be explicitly stated.

  2. Offers are non-binding. The entrepreneur may modify offers.

  3. Offers include a complete and accurate product/service description. Images are truthful representations.

  4. Prices exclude customs clearance costs and import VAT, which are the customer’s responsibility.

  5. Additional information required in offers: price, shipping costs, payment/delivery methods, right of withdrawal (if applicable), contract archiving, and language options.

Article 5 – The Agreement

  1. The agreement is concluded upon consumer acceptance of the offer.

  2. Electronic acceptance is confirmed immediately. Security measures for electronic agreements and payments are ensured.

  3. The entrepreneur may verify the consumer’s ability to fulfill payment obligations.

  4. Post-agreement, the consumer receives written information on complaints, right of withdrawal, warranties, and termination terms.

Article 6 – Right of Withdrawal

  1. The consumer may withdraw within 30 days after receiving the product.

  2. The product must be handled carefully and returned in its original state/packaging.

  3. The consumer must notify the entrepreneur of withdrawal within 30 days via email/written notice and return the product within 30 days (proof of return required).

  4. Failure to comply results in the sale being finalized.

Article 7 – Costs in Case of Withdrawal

  1. Return shipping costs are the consumer’s responsibility.

  2. Refunds are processed within 14 days after product receipt or proof of return.

Article 8 – Exclusion of Right of Withdrawal
Exclusions apply to:

  • Custom-made/personalized products.

  • Perishable goods, sealed audio/video/software, and hygiene products with broken seals.

  • Services related to leisure/transport started before the cooling-off period.

Article 9 – Price

  1. Prices remain valid during the offer period, except for VAT changes.

  2. Variable prices for financial market-dependent products must be indicated.

  3. Price increases within 3 months require legal justification; after 3 months, termination rights apply.

  4. Prices exclude import VAT/customs fees for non-EU deliveries.

Article 10 – Conformity and Warranty

  1. Products/services comply with agreements, specifications, and legal standards.

  2. Defects must be reported within 7 days of delivery.

  3. Warranty matches the manufacturer’s terms but excludes consumer misuse or government regulations.

Article 11 – Delivery and Execution

  1. Orders are processed within 1 day unless otherwise agreed. Delays allow consumer termination and refunds.

  2. Risk transfers to the consumer upon delivery.

Article 12 – Duration Transactions

  1. Termination rules:

    • Indefinite contracts: 1-month notice.

    • Fixed-term contracts: notice at term end.

  2. Automatic renewals require termination rights (1-month notice). Trial subscriptions end automatically.

Article 13 – Payment

  1. Payment is due within 7 working days after the cooling-off period.

  2. Incorrect payment details must be reported immediately.

  3. Late payments incur reasonable notified costs.

Article 14 – Complaints Procedure

  1. Complaints must be submitted within 7 days of defect discovery.

  2. Responses within 5 days; justified complaints result in repair/replacement.

Article 15 – Disputes
Dutch law applies exclusively, even for consumers residing abroad.
